Terms of Service

These terms apply to your use of mtaapi.dev's website, hosted transit API, dashboard, subscriptions, documentation, and API-key workflows.

1. Acceptance

These Terms of Service govern your access to and use of mtaapi.dev, including the website, dashboard, hosted API, documentation, API keys, and related services operated by Human Interface Design LLC.

By creating an account, generating an API key, subscribing to a plan, or using the hosted API, you agree to these Terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service

mtaapi.dev provides developer tools and hosted API access for MTA subway and bus data, including realtime arrivals, service alerts, nearby stops, and vehicle information. mtaapi.dev is not affiliated with, endorsed by, or sponsored by the Metropolitan Transportation Authority.

Transit data may be delayed, incomplete, unavailable, or inaccurate. You are responsible for deciding whether the service is appropriate for your application and for presenting transit information responsibly to your users.

3. Accounts And API Keys

You are responsible for keeping your account credentials and API keys secure. You must not share, sell, publish, or expose API keys except as required for your own application security model.

You are responsible for activity under your account and API keys. We may revoke, rotate, suspend, or limit API keys if we believe they are compromised, abused, or used in violation of these Terms.

4. Acceptable Use

You may not use the service to overload, probe, scrape, reverse engineer, disrupt, or bypass rate limits or access controls. You may not use the service for unlawful, harmful, deceptive, or security-abusive activity.

You may not resell the hosted API as a substantially similar standalone service without written permission. You may use API responses in applications, websites, internal tools, analyses, and user-facing products that add meaningful functionality.

5. Plans, Billing, And Credits

Paid plans, limits, prices, and features are shown on the website or dashboard and may change over time. Unless otherwise stated, subscriptions renew automatically until canceled.

Billing is managed through Clerk Billing and processed by our payment processor. You authorize us and our payment processor to charge applicable fees, taxes, and renewal amounts. Fees are non-refundable except where required by law or where we expressly state otherwise.

6. Availability And Changes

We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, specific response times, or permanent access to any particular endpoint or data source.

We may modify, suspend, or discontinue features, endpoints, plans, limits, or documentation. We will try to provide reasonable notice for material changes when practical.

7. Intellectual Property

Human Interface Design LLC owns mtaapi.dev, the hosted service, dashboards, documentation, branding, and related software except for third-party materials and open-source components.

You retain ownership of your applications and data. You grant us the limited rights needed to provide, secure, operate, and improve the service.

8. Disclaimers

The service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

You should not rely on the service for emergency, safety-critical, life-critical, or legally required transportation decisions.

9. Limitation Of Liability

To the maximum extent permitted by law, Human Interface Design LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.

Our aggregate liability for claims relating to the service will not exceed the amounts you paid to us for the service during the three months before the event giving rise to the claim, or $100 if you have not paid us.

10. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, create risk for the service or other users, fail to pay fees, or use the service in a way that may cause legal or operational harm.

Sections that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, and dispute terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where applicable law requires otherwise.
